TERMS & CONDITIONS


1. Contract Formation

1.1 By placing an order with MODA HANDBAG LTD, you agree to be bound by these Terms & Conditions.
1.2 A legally binding contract is formed when we receive full payment for your order and send you an order confirmation email.
1.3 If we are unable to fulfill your order due to stock limitations, delivery restrictions, or other issues, we will contact you to offer alternative solutions, such as:

  • Replacing the item with a similar product;

  • Delaying the shipment with your approval;

  • Cancelling the order and issuing a full refund.
    1.4 If we cannot contact you within 7 days of receiving your order, the order will be automatically cancelled.


2. Pricing & Payment

2.1 All prices listed on our website are in GBP (£) and exclude VAT, unless otherwise stated. A VAT charge of 20% applies to all UK customers unless an international customer provides a valid VAT exemption number before payment.
2.2 We accept the following payment methods: credit cards, debit cards, and bank transfers.
2.3 We DO NOT accept cheques as a form of payment.
2.4 Full payment is required before we process and dispatch your order, unless otherwise agreed in writing.


3. Order Cancellation

3.1 Cancellation by the Customer

  • Customers can cancel their order at any time before payment without incurring any charges.

  • Once payment has been processed, cancellation is no longer possible.

3.2 Cancellation by MODA HANDBAG LTD

We reserve the right to cancel an order in the following cases:

  • The item is out of stock;

  • We do not deliver to your location;

  • Pricing or description errors occurred;

  • The customer cannot be contacted within 7 days of placing the order.
    If we cancel your order, you will receive a full refund.


4. Delivery & Risk

4.1 UK Orders

  • We use a 24-hour delivery service provided by our shipping partners for all UK mainland orders.

  • Occasionally, delivery may take up to 48 hours due to unforeseen circumstances.

  • If your order has not arrived within 48 hours, please contact us immediately, and we will investigate the issue.

4.2 International Orders

  • Delivery times vary depending on the shipping provider and the destination country’s geographical location.

  • If your order has not arrived within 2 weeks, please contact us immediately, and we will assist in tracking the shipment.

4.3 Transfer of Risk

  • Once the order is delivered to the address provided by the customer, ownership and risk are transferred to the customer.

  • If your package is lost or damaged, please contact both us and the shipping provider as soon as possible so we can assist with the claims process.


5. Returns & Refunds

5.1 If the goods are damaged, defective, or incorrect, you must notify us within 10 working days of delivery. Depending on the situation, we will:

  • Replace the item;

  • Arrange for a repair (if applicable);

  • Issue a refund.

5.2 Returns will not be accepted if:

  • The product has been used;

  • The return request is made more than 14 days after delivery;

  • The issue results from normal wear and tear, accidental damage, or water exposure.

5.3 Return Shipping Costs:

  • If the item is faulty or incorrect, we will cover the return shipping costs.

  • If the return is due to a change of mind, the customer is responsible for return shipping fees.

  • Original shipping costs are non-refundable.


6. Liability & Warranty

6.1 New handbags are covered by the manufacturer’s warranty where applicable.
6.2 We are not liable for:

  • Normal wear and tear;

  • Water or liquid damage;

  • Accidental or intentional damage caused by the customer;

  • Loss of business, profits, or goodwill due to defective goods.


7. Force Majeure

We are not responsible for delays or failure to deliver due to events beyond our control, including but not limited to:

  • Natural disasters;

  • Strikes or labor disputes;

  • Supply chain disruptions;

  • Pandemics or government restrictions.


8. Privacy Policy

  • By placing an order, you agree to our Privacy Policy, which complies with the UK GDPR and Data Protection Act 2018.

  • Customer data is used only for order processing and communication and will not be shared with third parties without consent.

  • Customers can opt out of marketing emails at any time.


9. Governing Law & Dispute Resolution

9.1 These Terms & Conditions are governed by English law.
9.2 Any disputes shall be resolved in the courts of England and Wales.
9.3 Customers are encouraged to resolve disputes through alternative dispute resolution (ADR) before pursuing legal action.


10. Amendments

  • We may update these Terms & Conditions from time to time. Changes will be posted on our website and will apply to future orders.
